Cuando pensamos en la protecci\u00f3n de una obra literaria (como un libro, un c\u00f3mic), audiovisual (una pel\u00edcula, por ejemplo), etc., lo primero que se nos viene a la cabeza son los derechos de autor sobre dicha obra.<\/p>\n

No obstante, en la anterior entrada, ya vimos que tambi\u00e9n era posible proteger ciertos elementos de una obra de manera independiente, como, por ejemplo, sus personajes.<\/p>\n

Protecci\u00f3n jur\u00eddica de los personajes de ficci\u00f3n<\/a><\/p>\n

En esta entrada, vamos a descubrir c\u00f3mo aplicar estos conocimientos a la industria de los videojuegos.<\/p>\n

 <\/p>\n

LOS PERSONAJES DE VIDEOJUEGOS COMO PERSONAJES DE FICCI\u00d3N<\/strong><\/h3>\n

\"\"En primer lugar, para poder aplicar, al campo de los videojuegos, lo que aprendimos en la entrada anterior, los personajes deber ser de ficci\u00f3n<\/strong>.<\/p>\n

La categor\u00eda personajes de ficci\u00f3n<\/strong> podr\u00eda definirse, de manera muy r\u00e1pida, como aquella que aglutina a todos los personajes que no constituyen una figura real, es decir, que no representan a una persona real.<\/p>\n

Esta distinci\u00f3n es importante porque, en caso de tratarse de un personaje real<\/strong> no podr\u00eda ampararse en la protecci\u00f3n mediante derechos de autor. En ese caso operar\u00edan los derechos de imagen de la persona (si est\u00e1 viva), o la vertiente de este derecho en defensa de la memoria de un fallecido.<\/p>\n

Pongamos, por ejemplo, el caso de un videojuego como Assasin\u2019s Creed \u00ae,<\/strong> con un alto contenido hist\u00f3rico. En lo que respecta a personajes hist\u00f3ricos, estar\u00e1 protegida su presencia en la obra entendida como un todo, pero no gozar\u00e1n de protecci\u00f3n independiente ya que, entonces, el personaje no podr\u00eda ser considerado una obra al no cumplir con el requisito de la originalidad.<\/p>\n

Por tanto, la protecci\u00f3n a trav\u00e9s de los derechos de autor de la que hablaremos \u00fanicamente es predicable respecto de personajes de ficci\u00f3n<\/strong>, es decir, partimos de la base de que son inventados, producto de la creatividad del autor (aunque, como ya vimos, no basta solo con esto para constituir una obra protegible).<\/p>\n

MECANISMOS LEGALES DE PROTECCI\u00d3N DE LOS PERSONAJES DE VIDEOJUEGOS<\/strong><\/h3>\n

Dentro de las diferentes figuras que contempla la legislaci\u00f3n en materia de propiedad industrial e intelectual<\/strong> ya vimos, tambi\u00e9n, cu\u00e1les ser\u00edan las m\u00e1s adecuadas para proteger a los personajes de ficci\u00f3n.<\/p>\n

Por un lado, las marcas<\/strong>. Los derechos que generan estos signos distintivos son de vital importancia para una empresa, pues pueden explotarse, sin l\u00edmite temporal si se renuevan al final de cada periodo. En Espa\u00f1a y Europa, deben ser registrados para ser protegidos, pero, en EE.UU., no es as\u00ed, ya que all\u00ed, lo importante, es su uso en el mercado: quien lo usara primero, tiene los derechos.<\/p>\n

Existen muchos ejemplos, pero podemos hablar de la marca Sonic the Hedgehog<\/strong>.<\/p>\n
