Un videojuego, al igual que un ordenador, tiene un componente t\u00e9cnico (especialmente, el c\u00f3digo) que hace que funcione correctamente. Este funcionamiento requiere de una interacci\u00f3n del usuario con el sistema y esto tiene lugar a trav\u00e9s de la interfaz de usuario, que puede ser de diversos tipos, entre ellos, una interfaz gr\u00e1fica.<\/p>\n

Hoy, analizaremos c\u00f3mo se puede proteger, legalmente, la interfaz gr\u00e1fica de los videojuegos.<\/p>\n

ALGUNAS NOTAS SOBRE LA INTERFAZ GR\u00c1FICA DE LOS VIDEOJUEGOS<\/strong><\/h3>\n

Antes de analizar cu\u00e1l es el mejor instrumento de protecci\u00f3n legal para la interfaz gr\u00e1fica de los videojuegos, debemos recordar algunos conceptos<\/strong> que ya tuvimos ocasi\u00f3n de comentar, en profundidad, en la anterior entrada.<\/p>\n

Recordemos que la interfaz de usuario<\/strong> es el medio utilizado por este \u00faltimo para interactuar con una m\u00e1quina. Dicho elemento puede articularse a trav\u00e9s de distintos mecanismos, siendo, los m\u00e1s usados: los comandos<\/strong> (interfaz de l\u00ednea de comandos), elementos visuales<\/strong> (interfaz gr\u00e1fica de usuario) u otras herramientas<\/strong> como la voz (interfaz natural de usuario).<\/p>\n

Imaginemos un programa de ordenador como puede ser, por ejemplo, la calculadora. <\/strong><\/p>\n

Dicha aplicaci\u00f3n est\u00e1 compuesta por un c\u00f3digo que regula sus funciones y que es el que hace que funcione correctamente. Dentro de \u00e9l, se insertan las l\u00edneas necesarias para configurar su interfaz gr\u00e1fica: la colocaci\u00f3n de las \u201cteclas\u201d, el aspecto est\u00e9tico en su conjunto, etc.<\/p>\n

En el caso de un videojuego,<\/strong> es igual. Incluso, los equipos de desarrollo de la interfaz gr\u00e1fica pueden trabajar de manera independiente en este aspecto del juego, con herramientas espec\u00edficas y, posteriormente, implementarlo en el c\u00f3digo del videojuego.<\/p>\n

De esta manera, vemos que la interfaz gr\u00e1fica de un videojuego est\u00e1 compuesta<\/strong>, por un lado, por el c\u00f3digo necesario para configurarla a nivel t\u00e9cnico; y, por otro, por el resultado visual final. En muchas ocasiones, sin embargo, podemos encontrar que el t\u00e9rmino interfaz gr\u00e1fica de usuario se refiere, \u00fanicamente, a la apariencia visual.<\/p>\n

Aqu\u00ed, vamos a centrarnos, \u00fanicamente, en la protecci\u00f3n de la apariencia visual,<\/strong> pues, en ocasiones anteriores, ya hemos tratado la protecci\u00f3n de los videojuegos mediante derechos de autor.<\/p>\n

El Derecho espa\u00f1ol y comunitario<\/strong> nos brinda diversos mecanismos de protecci\u00f3n<\/strong> que podr\u00edan ser aplicables en este caso. Principalmente, hablamos de las diferentes figuras legales de propiedad industrial e intelectual (PI).\"\"<\/strong><\/p>\n

Adem\u00e1s, para aquellos casos en que estas no puedan ser de aplicaci\u00f3n, podemos acudir a la regulaci\u00f3n en materia de competencia desleal<\/strong> (actos de confusi\u00f3n, imitaci\u00f3n\u2026).<\/p>\n

Brevemente, veamos qu\u00e9 figuras de PI existen y c\u00f3mo encajar\u00edan en la protecci\u00f3n de la interfaz gr\u00e1fica de usuario presente en los videojuegos.<\/p>\n
